These Terms of Service (“Terms”) govern your access to and use of the services provided by Empire Parking LLC (“Company,” “we,” “our,” or “us”). By using our parking services, website, or related offerings (collectively, the “Services”), you agree to be bound by these Terms. If you do not agree, you may not use our Services.
1. Use of Services
- You agree to use the Services only for lawful purposes.
- You are responsible for providing accurate and complete information when using our Services, including vehicle and payment details.
- We reserve the right to refuse service, suspend access, or remove any vehicle in violation of these Terms.
2. Parking Services
- Parking is provided on a space-available basis. We do not guarantee availability unless expressly reserved and confirmed.
- Vehicles must be legally registered, insured, and in safe operating condition.
- You are responsible for securing your vehicle (e.g., locking doors, removing valuables).
3. Fees & Payments
- All fees must be paid in accordance with posted rates or reservation terms.
- Payments are due at the time of service, unless otherwise arranged.
- We may use third-party processors to handle payments. By paying, you authorize us and our payment processors to process your transaction.
4. Liability & Disclaimers
- Empire Parking LLC is not responsible for theft, loss, or damage to vehicles or personal property left in vehicles, except as required by law.
- Parking is at your own risk. We strongly encourage removing valuables before leaving your vehicle.
- To the maximum extent permitted by law, our liability is limited to the lesser of: (a) the amount paid for the Services, or (b) $250.
5. Customer Responsibilities
- You must comply with all posted signs, instructions, and applicable laws.
- You may not leave abandoned, hazardous, or illegal vehicles on our property.
- You agree to indemnify and hold harmless Empire Parking LLC from any claims, damages, or costs arising from your use of the Services or your vehicle.
6. Reservations & Cancellations
- Reservations, where offered, are not transferable.
- Cancellation policies may vary by location or service type and will be communicated at the time of booking.
- No-shows may be charged the full amount of the reservation.
7. Prohibited Conduct
You may not:
- Use the Services for unlawful or unauthorized purposes.
- Tamper with equipment, gates, or property belonging to Empire Parking LLC.
- Engage in abusive, unsafe, or disruptive behavior on our premises.
8. Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and share customer information.
9. Changes to Terms
We may update these Terms at any time. The updated version will be posted with a new Effective Date. Continued use of the Services after changes constitutes acceptance of the revised Terms.
10. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the State of Florida.
- In the event of a dispute, you agree to attempt mediation before arbitration or legal action.
- Any legal action must be filed in a court located in Miami-Dade County, Florida.
